NebuAd
Media company offering online advertising solutions
About NebuAd
NebuAd, Inc. was an online advertising firm founded in 2006 by Robert Dykes and Kira Makagon, with its headquarters in Redwood City, California. The company, which also had offices in New York and London, secured funding from investment firms Sierra Ventures and Menlo Ventures. NebuAd's business model was centered on behavioral targeting, achieved by partnering with Internet Service Providers (ISPs) to analyze their customers' web browsing habits. This was accomplished through deep packet inspection (DPI) technology, which monitored user traffic to deliver targeted advertisements.
The company's core offering was a system that placed hardware within an ISP's network to monitor the online activities of potentially thousands of users. This platform analyzed data points such as web searches, page views, and time spent on sites to categorize users into one of thousands of interest segments. In return for granting NebuAd access to their networks, ISPs received a share of the advertising revenue, with one provider anticipating earnings of at least $2.50 per user per month. At its peak, NebuAd had agreements with over 30 ISPs, covering approximately 10% of American broadband users.
The firm's methodology sparked significant controversy surrounding user privacy. Critics and privacy advocates raised concerns about the practice of monitoring all of a user's internet traffic, which some likened to wiretapping. The legality of the practice was questioned under existing laws like the Electronic Communications Privacy Act. This led to Congressional hearings and intense public scrutiny, with lawmakers arguing that such services should require explicit user opt-in rather than an opt-out system. Consequently, major ISP partners, including Charter Communications, Embarq, and Wide Open West, suspended or terminated their trials and partnerships with NebuAd. The backlash culminated in a class-action lawsuit alleging violations of several privacy and computer crime laws. Faced with mounting legal pressure, the loss of its client base, and a leadership shakeup that included the resignation of CEO Bob Dykes, NebuAd ceased its UK operations in August 2008 and its US operations in May 2009.
